House rules and reservation basics
  1. Property. The property is a short term vacation rental which is privately owned and maintained. Please treat it with the same care you would use with your own home and leave it in the same condition it was in when you arrived.
  2. Guest. The guest is the individual listed as the primary booking holder on the checkout page when reserving the property.
  3. Rental. The booking holder and travel party are transient occupants, not tenants, and no anti-eviction laws apply to this rental. The property may not be used for mail delivery, vehicle registration, or the registration of individuals.
  4. Rental Party. The booking holder and any affiliates or associates who enter the property or surrounding area are referred to as the rental party. All persons in the rental party are bound by this agreement.
  5. Rental Agreement Term. The term of this agreement runs from the reserved check-in date to the reserved check-out date shown on the checkout page, together with any reservation modification confirmed in writing by the owner through automated or manual confirmation.
Occupancy, overnight stays, and behavior standards
  1. Conduct. The booking holder and rental party shall conduct themselves in a manner that will not disturb neighbors or the community. Repeat complaints from neighbors and/or police may result in the rental party being asked to vacate the property immediately and forfeit all reservation charges paid.
  2. Outside noise must be kept to a minimum between 10:00 PM and 6:00 AM.
  3. Maximum Occupancy. Unless otherwise agreed in writing by the owner, the maximum number of persons allowed to stay overnight at the property is limited to the adults, children, and infants identified on the checkout page when reserving.
  4. Overnight Guests. Overnight occupants are individuals staying at the property between 11:00 PM and 7:00 AM.
  5. Check-In / Check-Out. The rental party may check in no earlier than the check-in time shown on the checkout page and must depart no later than the confirmed check-out time. Failure to depart by check-out time results in a charge for an additional day. Failure to vacate on the reserved check-out date without prior written authorization to extend the stay results in a charge for an additional day plus a 50% penalty per day. Early check-in and late check-out requests are based on availability, must be made in writing at least 24 hours prior to arrival, and may carry additional charges.
Check-in, pets, smoking, and safety devices
  1. Rental Rules. If the rental rules are not followed, the booking holder and rental party may be asked to vacate the property immediately and forfeit all reservation charges paid.
  2. Guest Age. The booking holder must be 21 years of age or older to reserve, is responsible for, and must accompany all individuals under the age of 21 throughout the stay.
  3. Guest Identification. Photo identification and a selfie may be requested, either in person or via electronic delivery, upon check-in. Reservations paid with a credit card in another individual’s name may require additional documentation from the cardholder.
  4. Guest Responsibility. The primary booking holder assumes responsibility for the conduct and safety of the rental party and for any damage to the property caused by a member of the rental party.
  5. Criminal Activity Prohibited. The use of the property for any criminal activity is prohibited, and the owner agrees to cooperate fully with law enforcement in the investigation and/or prosecution of criminal activity.
  6. Firearms. Unless written approval from the owner is received in advance of the stay, firearms are prohibited on the property.
  7. Dangerous or Hazardous Items. Dangerous or hazardous items which may cause harm to individuals, the property, or the surrounding area are strictly prohibited, including but not limited to fireworks.
  8. Smoking/Vaping. Unless otherwise posted, smoking and/or vaping is not permitted on the property. Smoke damage, including odor, is not covered by standard cleaning or damage waiver and will be assessed a $250 fee.
  9. Safety Devices. The property may be equipped with external cameras for the safety of occupants and the property. These safety devices do not view the interior of the home unless an interior space is designated as private or off limits.
  10. Pets. Pets, including emotional support animals, may be permitted and must be disclosed at the time of reservation. When permitted, a pet fee will be shown on the checkout page. If no option to include pets is available when booking, pets are not permitted. Service animals are permitted as required by law. Unless required by law, emotional support animals are considered pets for the property’s pet policy. Undisclosed pets are not permitted on the property grounds. Failure to observe the pet policy may result in a minimum $200 fine, and the rental party may be asked to vacate immediately and forfeit all reservation charges paid.
Payments, cancellation, cleaning, parking, and maintenance
  1. Payment. The booking holder agrees to pay the reservation total, including all fees and taxes, as described on the checkout page. This agreement may be terminated by the owner upon default of payment or other obligations. Disputed charges may be recovered through local court and will carry a $150 processing fee plus court costs.
  2. Cancellation. The applicable cancellation policy is the one displayed on the checkout page for the reservation. If cancellation occurs before the penalty and/or non-refundable period, a full refund less credit-card processing fees will be issued. If cancellation occurs within the penalty and/or non-refundable period, the appropriate fee up to 100% of the reservation cost will be assessed.
  3. When present, cancellation penalties are not waived due to inclement weather or other conflicts whether within or outside the booking holder’s control. No refunds are given for late arrivals, early departures, or unused days. Trip cancellation insurance is strongly recommended.
  4. Damage Waiver. The Waivo damage waiver collected as a per-stay fee provides coverage against accidental damage to the property incurred during the stay when reported prior to check-out. Damage above the coverage amount, or damage not reported before check-out, may result in additional charges at the host’s discretion. Coverage decisions are made solely by Waivo.
  5. Cleaning. A cleaning fee may be charged when displayed on the checkout page. Daily, weekly, or other in-stay housekeeping is not included in the rental rate. On check-in day, the booking holder is responsible for inspecting the property and informing the owner if it requires additional cleaning or is not in good condition. Additional cleaning caused by negligence or failure to follow this agreement may result in additional charges.
  6. Parking. Parking details are available in the parking and facilities section of the amenities. Unless otherwise disclosed, free on-site parking is not available. Vehicles parked illegally are subject to penalty and/or towing at the vehicle owner’s expense. The owner is not responsible for parking fees, or for the safety or security of vehicles or their contents.
  7. Owner Maintenance. The owner attempts to properly maintain the property but cannot guarantee against mechanical failure of electrical service, plumbing, water supply, heating, air conditioning, electronic equipment, internet access, cable service, amenities, or appliances. Maintenance issues should be reported immediately. The owner will make reasonable efforts to complete repairs quickly, and the rental party agrees to allow access for repair and inspection. No refunds or reductions in reservation cost will be made due to failure of such items.
Liability, legal process, and enforcement
  1. Acts of God. If a mandatory evacuation order is issued by state or local authorities, the booking holder is entitled to a prorated refund for each night the property cannot be occupied and must immediately vacate. This does not include weather advisories or travel advisories.
  2. Indemnification. Use of the property by the rental party and visitors is entirely at their own risk. The booking holder will indemnify and hold harmless the owner, representatives, and software providers from any expenses, costs, damages, suits, actions, or liabilities arising from loss of or damage to personal property, injury, or death resulting from the use or occupancy of the property or the failure to observe the rules and restrictions in this agreement.
  3. Violation of Agreement. If the booking holder or any member of the rental party violates the terms of this agreement, including but not limited to maximum occupancy, visitors, rental rules, or restrictions, the owner may evict the rental party and all reservation costs and security deposit amounts paid may be forfeited.
  4. Governing Law. This agreement and all transactions contemplated by it are governed by and construed in accordance with the laws of Ontario, excluding its conflicts of laws provisions. Any dispute arising from this agreement shall first be resolved through mediation. If mediation does not resolve the dispute, the matter shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association.
  5. No Waiver. Neither the owner nor the booking holder shall be deemed to have waived any provision of this agreement or the exercise of any rights under it unless that waiver is made expressly and in writing.
